New Complaint Filed Against Lexis Nexis, Over Personal Information Collected and Distributed to Law Enforcement

A privacy suit against Lexis Nexis Risk Solutions was removed to federal court last week, six weeks after it was originally filed in the Circuit Court of Cook County. The complaint was filed by several Chicago-area activists, who are objecting to Lexis Nexus’s bulk sale of personally identifiable data, specifically regarding the sale of this information to law enforcement  agencies. Lexis Nexis offers data available to purchase, the company claims the information is 99% accurate, and that there are 276 million so-called “Lexis IDs.” Put into context, there are just over 258 million American adults, according to the 2020 census. The complaint, primarily brought by immigration activists, alleges that law enforcement is permitted to buy this information, including license plate scanner information, and is in turn, able to obtain farm more information than would be possible through other methods. Trade secrets and unfair competition complaint - Gallagher v. Alliant Insurance

Arthur J. Gallagher & Co. filed a federal lawsuit Thursday against Alliant Insurance Services, Inc. In the Northern District of Illinois.   The 43 page Complaint alleged several different causes of actions including: I. Tortuous interference with a contract; II. Tortious interference with prospective economic advantage;  III. Aiding and abetting breach of fiduciary duty; and  IV. Conspiracy.  While each element requires a fact-intensive analysis, there are several themes and considerations to consider as they play out. First, the crux of the dispute arises as Alliant allegedly has repeatedly recruited employees from Gallagher.  Per the Complaint, as they are recruited, they are asked to retain certain types of confidential information. LKQ Corp. v. Shipman - Executive Noncompetes and Confidentiality

Many states, Illinois included, have implemented significant restrictions on non-compete and restrictive covenants in employment, generally. In the Land of Lincoln, new legislation went into effect this year which proactively bans many forms of non-compete agreements, while it has also added a breadth of regulatory barriers to required to include types of restrictive covenants on any employee. Notably, these requirements were not retroactive and therefore, have no bearing on employment agreements entered into prior to January 1, 2022.  LKQ Corporation and Keystone Automotive Industries, Inc. filed suit earlier this month against Christopher Shipman, a former Senior Manager who served as Territory Director for LKQ’s mobile services division.
